What does undivided co-ownership mean?
When you bought a property together, you also became co-owners. As long as that ownership is not formally divided, you are in undivided co-ownership. Simply put: you own the property together, each for a share, even if only one of you still lives there.
After a divorce or breakup, the undivided co-ownership remains until you take action. The undivided co-ownership of the property is not automatically resolved by separating. Both partners remain owners, and usually the joint mortgage loan also continues in both names.
This is important to know, because as long as the property is not divided or sold, you remain financially linked. You are jointly liable for the loan with the bank, even if one of you already lives elsewhere.
