What happens to the family home in a divorce with children?
The family home has extra legal protection: neither partner may sell it without the other's consent, even if the home is only in one name. At the family court, you can arrange who stays temporarily, often with the children. Then comes the choice: sell or one partner buys out the other.
In Belgium, the family home, the place where the family actually lives, is legally protected (article 215 of the old Civil Code). As long as you are married or legally cohabiting, neither of you can sell, give away, or mortgage the home without the other's consent. This applies even if the home is only in one partner's name. This way, no one can make hasty decisions about the roof over the children's heads.
Who stays in the home during the divorce can be agreed between you or arranged through provisional measures at the family court. The judge primarily looks at the best interests of the children. Important: staying in the home does not give you an extra right to take it over later. The final solution is usually selling or one partner buying out the other.
