If you take over the house from your ex-partner during a divorce, you "leave the undivided co-ownership". At that moment, the tax authorities levy the division duty, commonly known as the miserietaks. Important to know: the rate depends on the region where the property is located, and there is a more favorable rate specifically for people who are separating.
In Flanders, you pay 1% instead of 2.5% in that case, provided you meet a few rules. In Brussels, the rate is 1%. In Wallonia, 1% remains for divorces, even though the general rate there increases to 3% during 2026. Always calculate on the full value of the house, not just the part you are buying out.
