In short
Should you sell the house before or after the divorce?
There is no single right answer: it depends on your agreements, your financial situation, and whether you want to sell together or if one of you will stay. Often, agreements about the home are made before the divorce is final, while the actual sale happens later.
In a divorce by mutual consent, you usually set out the fate of the home in the settlement deed, before the court pronounces the divorce. The sale itself can happen afterwards. This way, you separate the emotional knot (the divorce) from the practical side (the sale), without being left without agreements.
Important to know: selling to an external buyer and a home where one of you buys out the other are treated very differently for tax purposes. That choice often weighs more heavily than the exact timing. We list the pros and cons, but for your specific case, it's best to consult your own notary, lawyer, or mediator.
